Terms and conditions of sale

These general terms of sale govern purchases made on the ZapFromJapan website (the “Site”), operated by Luchetti Lorenzo, VAT no. 17891071007, registered at Via delle Calendule 12, 00172 Roma (RM), Italia (the “Seller”), in accordance with Italian Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003.

1. Subject

The Site sells original Japanese Pokémon collectible cards (Art Rare, Special Art Rare and complete sets). The published images show the cards as an indication of the type of item; since these are collectibles, slight variations in centering, printing or surface fall within normal manufacturing tolerance and do not constitute a lack of conformity.

2. Prices and availability

All prices are in euros, VAT included where applicable, and do not include shipping costs, which are shown separately before the order is confirmed. Collectible card prices follow the market and may change without notice; the price shown when the order is confirmed applies. In the event of an obvious material error in the price (e.g. a clear error compared with the market value), the Seller may cancel the order and refund the full amount paid, with no further obligation.

3. Conclusion of the contract

The order sent by the customer is a contractual offer. The contract is concluded only when the Seller confirms shipment. The Seller may refuse anomalous orders or orders that do not comply with these terms, refunding any amount already collected.

4. Payments

We accept credit/debit cards, Apple Pay and Google Pay (through a PCI-DSS certified provider), PayPal and bank transfer. The Seller never has access to payment card data. For bank transfer orders the goods are reserved for 5 business days; if the payment is not received within that time, the order is cancelled.

4-bis. Reservations on external platforms and deposit

By choosing “Buy on Vinted / Subito / Wallapop”, the items are reserved and the transaction (payment and shipping) is completed on the chosen platform. The reservation is valid for 24 hours from receipt of the email with the link to the listing; after that the items become available again.

The Customer may optionally pay on the Site an amount of their choice (minimum €5, maximum the reservation total minus €1), which is fully deducted from the listing price on the platform. In that case the reservation is extended to 48 hours. Of the amount paid, the portion up to 20% of the reservation value is paid as a confirmatory deposit under Article 1385 of the Italian Civil Code; any excess is an advance on the price.

Within the 48 hours the Customer may cancel the reservation and receive a full refund of the amount paid. If the 48 hours expire without the purchase being completed, the advance on the price is refunded while the deposit is retained by the Seller under Article 1385(2) of the Civil Code; if the breach is the Seller’s (listing not published), the deposit is returned doubled. The consumer’s rights under the Consumer Code remain unaffected.

Shipping through an external platform. When the purchase is completed on Vinted, Subito or Wallapop, shipping is arranged and managed by the platform itself and the carrier it appoints: the Seller does not choose or control the courier and is not liable for delays, loss, theft or damage during transport, which (including claims and compensation) are governed by the terms of the platform and the carrier. The sale is completed when the parcel is handed to the carrier through the chosen platform: consequently, in case of loss or non-delivery attributable to the carrier, any amounts paid by the Customer on the Site are definitively retained by the Seller for the service already performed, without prejudice to the Customer’s rights against the platform and the carrier. These terms apply in full to every reservation shipped through an external platform.

5. Shipping and delivery

Orders are shipped within 2 business days of receiving payment, with a tracked courier. Each card is protected by a rigid top loader and protective cardboard. Delivery times given by the courier are indicative and not essential: delays attributable to the carrier do not entitle the customer to compensation beyond what mandatory law provides. The risk of loss or damage passes to the consumer only upon physical delivery of the goods, unless the consumer independently chose a carrier other than those offered by the Seller, in which case the risk passes on delivery to the carrier.

6. Right of withdrawal

Consumers may withdraw within 14 days of delivery, without giving any reason, under Articles 52 et seq. of the Italian Consumer Code, by writing to lorenzoprosell@gmail.com (also using the model form on the Returns and refunds page, which sets out the procedure and deadlines in detail). Conditions, within the limits of the law:

• the cards must be returned in the same condition in which they were delivered, in the sealed top loader where present, without signs of handling beyond what is necessary to establish their nature and characteristics; the consumer is liable for any diminished value resulting from other handling (Art. 57 Consumer Code);
• return shipping costs are borne by the consumer (Art. 57(1));
• the refund, including only the initial standard shipping costs, is made within 14 days of the withdrawal; the Seller may withhold it until the goods are received or proof of their return is provided (Art. 56(3));
• we recommend a tracked and insured return: the risk of the return shipment lies with the consumer.

7. Legal guarantee

The goods are covered by the legal guarantee of conformity under Articles 128 et seq. of the Consumer Code. As these are collectibles sold as new unless otherwise stated, intrinsic manufacturing characteristics (centering, slight printing imperfections) and normal fluctuations in market value do not constitute a lack of conformity. Buyers acting with a VAT number are covered only by Articles 1490 et seq. of the Civil Code, with defects to be reported within 8 days of discovery and a one-year limitation period. Consumers must report a lack of conformity within 2 months of discovering it.

8. Limitation of liability

To the maximum extent permitted by law, the Seller is not liable for indirect damage, lost resale opportunities or fluctuations in the collectible value of the cards. Liability for wilful misconduct or gross negligence and any liability that cannot be excluded by law remain unaffected.

9. Intellectual property

Pokémon and the related names and images are trademarks and works of their respective owners (©Pokémon / Nintendo / Creatures / GAME FREAK). The Site sells only original cards and is independent from, and not affiliated with, The Pokémon Company.

10. Governing law and jurisdiction

These terms are governed by Italian law. For consumers, the court of the consumer’s place of residence or domicile has jurisdiction; in all other cases the Court of Rome has exclusive jurisdiction. Complaints should be sent to lorenzoprosell@gmail.com; the Seller does not adhere to any alternative dispute resolution (ADR) body, except where adherence is mandatory.
